Terms of Service

1. Acceptance of These Terms

By accessing or using PropertyIntel360.com, placing an order, or accessing a purchased digital product after being given notice of these Terms, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service or complete the purchase.

2. PropertyIntel360 Platform

PropertyIntel360 is a real-estate technology, information, education, marketing, and service-routing platform. FSBO Discovery is a PropertyIntel360 product and division focused on homeowner education and For Sale By Owner resources. Other divisions and services may be added or changed over time.

3. Educational and Informational Nature

Unless a specific service expressly states otherwise, PropertyIntel360 and FSBO Discovery provide general educational, organizational, marketing, and informational resources. They are not a law firm, attorney, tax adviser, title company, escrow company, real-estate broker, appraiser, inspector, surveyor, engineer, accountant, or other licensed professional service.

Real-estate laws, forms, fees, procedures, government guidance, and local requirements can change. You are responsible for verifying current requirements and obtaining qualified professional assistance when your transaction requires legal, tax, title, brokerage, appraisal, inspection, surveying, engineering, accounting, closing, or other licensed services.

4. Purchases, Pricing, Taxes, and Payment

Product prices are shown before purchase. Applicable sales tax or other transaction taxes may be calculated and added at checkout. Payment processing may be handled by third-party providers, including Stripe. We may refuse, cancel, or review an order where payment is not completed, cannot be verified, appears fraudulent, or does not match the product or jurisdiction selected.

5. Digital Delivery and Access

Digital products may be delivered through secure, time-limited, or access-limited links. The purchaser is responsible for providing a working email address, downloading the purchased package within the available access period, extracting the ZIP file where applicable, and keeping a backup copy.

Legitimate purchasers who need recovery assistance may use the purchase-recovery process provided by PropertyIntel360 or contact office@propertyintel360.com. Recovery access may be limited in duration and may require order verification.

6. Order Problems, Refunds, and Charge Issues

If you experience a duplicate charge, failed delivery, incorrect jurisdiction package, or other order problem, contact office@propertyintel360.com. Refund eligibility, if any, is determined by applicable law and any refund terms specifically presented for the product or transaction. Nothing in these Terms waives rights that cannot legally be waived.

7. No Guaranteed Outcome

PropertyIntel360 and FSBO Discovery do not guarantee a property sale, sale price, time to closing, legal compliance in every circumstance, tax savings, avoidance of disputes, buyer interest, marketing performance, or any other specific financial or transaction outcome. You remain responsible for property-specific facts, representations, decisions, negotiations, deadlines, official filings, professional selection, and the final transaction.

8. Intellectual Property

PropertyIntel360 and FSBO Discovery names, branding, original text, explanations, instructions, graphics, organization, selection and arrangement, software, and other protectable materials remain the property of PropertyIntel360 or the applicable rights holder. Government materials and third-party materials remain subject to their own legal status, ownership, and usage rules.

9. FSBO Discovery Purchaser License

When you purchase an FSBO Discovery digital product, the purchase provides a limited license to the original purchaser. It does not transfer ownership of copyrights, trademarks, source files, publishing rights, or resale rights.

9.1 Personal-use license

The original purchaser receives a limited, nonexclusive, nontransferable, nonsublicensable license to use the purchased FSBO Discovery product for the purchaser's own personal, noncommercial FSBO purposes.

9.2 Permitted printing and transaction use

The purchaser may print reasonable working copies for the purchaser's own transaction and may complete the provided worksheets, checklists, logs, and other intended purchaser-use materials. The purchaser may provide completed forms, transaction-specific excerpts, or reasonably necessary portions to the purchaser's attorney, notary, title or escrow provider, lender, tax professional, inspector, closing professional, buyer, or other transaction participant when reasonably necessary to complete the purchaser's own sale. This does not authorize delivery of the complete product for another person's independent use.

9.3 Prohibited uses

Unless expressly authorized in writing by PropertyIntel360, you may not:

• share, lend, transmit, post, publish, distribute, upload, or make the complete product or substantial portions available to another person, website, shared drive, repository, file-sharing service, social platform, marketplace, or public or shared database;
• sell, resell, rent, lease, sublicense, bundle, give away, or commercially distribute the product;
• remove or defeat copyright notices, FSBO Discovery branding, purchaser-identification marks, license notices, watermarks, or other reasonable rights-management information;
• translate, adapt, rewrite, repackage, extract, compile, or create a derivative manual, course, toolkit, database, checklist collection, or competing commercial product from the licensed content;
• use the product or its proprietary content to train, populate, or build a commercial dataset, knowledge base, model, automated service, or competing information product; or
• represent FSBO Discovery material as your own original work or claim ownership of PropertyIntel360 intellectual property.

9.4 Purchaser identification and anti-piracy measures

Licensed copies or order records may contain non-sensitive purchaser or transaction identifiers for customer service, license administration, delivery control, and anti-piracy purposes. You may not intentionally remove or defeat lawful purchaser-identification marks or license metadata.

9.5 Updates and versions

A product's verification date, revision date, or version applies only to that version. Unless a specific offer states otherwise, purchase of one version does not create a perpetual obligation to provide future revisions, new editions, legal updates, replacement files, or continuing monitoring.

9.6 License termination

The product license may terminate if the purchaser materially violates the license terms, subject to applicable law. Termination does not waive rights or remedies otherwise available to the applicable rights holder.

10. Third-Party Services and Links

Our site may link to government agencies, payment providers, real-estate professionals, service providers, social platforms, or other third parties. We do not control third-party websites, availability, content, privacy practices, terms, licensing, or services. A link or referral does not by itself guarantee or endorse a third party's performance.

11. Professional and Regulated Services

Where brokerage, MLS access, legal work, title work, closing, appraisal, inspection, surveying, tax, or other regulated services are offered or referenced, those services must be performed by appropriately licensed or authorized providers where required. PropertyIntel360 does not claim to perform a regulated service merely by providing educational content, technology, marketing, referrals, or routing.

12. Acceptable Use

You may not misuse the website or services, interfere with security or availability, attempt unauthorized access, use automated means to abuse checkout or download systems, submit fraudulent payment information, infringe intellectual-property rights, or use the platform for unlawful activity.

13. Availability and Changes

We may update, correct, suspend, discontinue, or change website features, product descriptions, availability, delivery methods, or services. We may also update these Terms. The current version will be posted at this URL with its updated date.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website, educational materials, and digital services are provided on an "as available" basis. We do not warrant that every page, link, law, form, third-party resource, or service will always be current, available, error-free, or suitable for every property or transaction.

15. Limitation and Consumer Rights

Nothing in these Terms is intended to exclude or limit liability or consumer rights that cannot legally be excluded or limited. Any limitations that apply are subject to applicable law and the specific facts of the transaction.

16. Severability and No Waiver

If a provision is held unenforceable, the remaining provisions remain effective to the fullest extent permitted by law. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
